Terms & Conditions

By purchasing, activating or using your membership, you agree to be bound by these Terms, our Privacy Policy and any other applicable policies.

1. Membership Subscription Plans and Fees

1.1. Membership Tiers : We offer the following membership tiers :- 3 months, 6 months and 12 months subscription plans.The specific benefits, services, and access rights (“Benefits”) for each tier are detailed on our website (LINK to membership page).

1.2. Membership Fees : You agree to pay all applicable fees for your chosen Membership tier (Membership Fees”). Fees are quoted in (Malaysian Ringgit) and are subject to applicable taxes.

1.3. Payment Authorization : By providing a payment method, you authorized us to charge all Membership Fees and any other charges (eg, late fees, reinstatement fees) to that payment method.

1.4. Fee Changes : We reserve the right to change Membership Fees at any time. Your continued use of the Membership after the fee change constitutes your agreement to the new fees.

2. Term and Termination

2.1. Term : These terms remain in effect for as long as you maintain an active Membership.

2.2. Termination by Us: We may suspend or terminate your Membership immediately for any breach of these Terms, including but not limited to: (a) failure to pay fees; (b) fraudulent or abusive behaviour; © violation of our code and conduct; or (d) any action that disrupts our services or other Members.

2.3. Effect of Termination : Upon termination, your right to access and use all Member Benefits ceases immediately. Termination does not relieve you or your obligation to pay any outstanding fees.

3. Member Conduct and Account

3.1. Account Responsibility : You are responsible for maintaining the confidentiality of your account login information and for all activities that occur under your account.

3.2. Acceptable Use : You agree to use the Membership and its Benefit in a lawful and respectful manner. You will not : harass other Members, upload malicious code, attempt to gain unauthorized access to our systems, or use the Membership for any illegal purpose.

4. Modifications to Terms or Benefits

We reserve the right, at our sole discretion, to modify, suspend, or discontinue any aspects of the Membership Benefits or these Terms at any time. We will provide notice of material changes to the Terms (eg. via email, by posting a notice on our website). Your continued use of the Membership after such changes constitutes your acceptance of the new Terms.

5. Limitation of Liability

To the fullest extent permitted by law, (Activesphere Sports) and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or use the Membership: (b) any conduct or content of any third party on the service (offers and benefits by third party brands are not fulfilled for any reason or have become invalid or expired).

Our total liability to you for any claim arising out of or relating these Terms or the Membership shall not exceed the total amount of Membership Subscription Plan Fees you have paid to us in the six (6) months prior to the event giving rise to claim.

6. Disclaimer of Warranties

The Membership and all included Benefits are provided on an “AS IS” and “AS AVAILABLE” basis without any warranties of any kind. We disclaim all warranties, express or implied, including, but not limited to, implied warranties or merchantability, fitness for particular purpose, and non-infringement.

7. Intellectual Property

All content, features, and functionality available through the Membership (including text, graphic, logos, and software) are the exclusive property of Activesphere Sports or its licensors and protected by copyright, trademark, and other intellectual property laws.

8. Governing Law and Dispute Resolution

9.1. Governing Law : These Terms shall be governed by the laws of Malaysia without regard to its conflict of law provisions.

9.2. Dispute Resolution : Any dispute arising from these Terms shall be resolved through final and binding arbitration, rather than in court. Arbitration will be conducted by the Malaysian Arbitration Association under its commercial rules.

9. General Provisions

10.1. Entire Agreement : These Terms constitutes the entire agreement between you and Activesphere Sports regarding the Membership and supersede all prior agreements.

10.2. Severability : If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

10.3. Force Majeure : We are not liable for any failure to perform due to causes beyond our reasonable control, including acts of God, war, terrorism, pandemics, or internet outages.
